Please read this page very carefully before using this website, for your acceptance of the terms and conditions set out hereafter will be deemed upon your use of it. Should you not be prepared to be bound by each and every provision that follows, please exit.

Luxury Homes Australia ("LHA") will at all times act diligently and with all due care, but accepts no responsibility whatsoever for, and no party shall make any claim for any loss and/or damage suffered directly or indirectly consequential upon your using or viewing this website, or any material published by, through or linked to the same. LHA is excluded to the fullest extent permitted by the law from any responsibility and/or liability for any such loss/damage, and all conditions and/or warranties implied by the Trade Practices Act 1974 (C'lth) and/or the Fair Trading Act 1989 (Q'ld) are hereby negatived. You agree that the liability of LHA that cannot be so negatived, is limited to a resupply of the service provided.

You agree to indemnify and keep indemnified LHA against all liabilities including legal costs on a full indemnity basis, as a result of any legal proceedings brought against LHA by any third party in respect of your published material.

LHA gives no assurances that defects or errors will not occur in the website, that it's ISP will operate at all times without technical failures, or that it will be unaffected by viruses. You acknowledge that errors and delays can occur in the transmission of data over the internet. You acknowledge that the format of the website can change at any time without notice to you.

LHA will not be obliged to monitor or censor the material submitted, but reserves the right, at its sole discretion, to edit any such material, or to refuse to publish any material.

LHA makes no representations and gives no assurances that any advertisement will succeed, nor what responses may result, nor even the likelihood of any hits.

LHA gives no warranties in relation to any material published, or the ownership, availability, suitability, fitness or quality of any property advertised on the website.

You agree to advertise only properties that are currently available for sale, to email LHA a withdrawal of the same within 24 hours of a Sale Contract becoming unconditional, to ensure that submitted material is correct in every respect, that the material will not offend any of the laws of Australia, its States and Territories, and will not contain anything that could expose LHA to legal proceedings or sanctions.

You agree to pay the fee notified to you, in advance by credit card and LHA thereupon agrees, subject to the above terms and conditions, to publish your advertisement on this website for a period of XXXX month/s. In the event that you wish to re-advertise, then these same conditions apply again but LHA reserves the right to alter the fee and the said terms and conditions, at any time.

You agree that the above comprises the entire agreement between us, that you cannot assign the Agreement without the written consent of LHA, that any notices between us be emailed, that the law of Queensland governs this Agreement, that only Queensland Courts have jurisdiction and that any delay in enforcing any of the provisions of this Agreement are not to be construed as a waiver of those provisions.
